Terms of Use and Conditions of the CallCar Application
For the Partner, the Driver, and the Renter
Terms and Conditions
FOUR S is an advertising services company. FOUR S has full and exclusive ownership of the "CallCar" software, which it makes available to its Partners for the latter to advertise their products and/or services to third parties. CallCar provides its software and undertakes the advertising and promotion of offers to third parties, services provided by companies active in the tourism and passenger transport sector. It offers its services under the following terms of use (hereinafter for brevity referred to as the "Agreement"), which constitute a legally binding agreement between the User and FOUR S, which is a Greek company and/or any subsidiary and affiliated company (hereinafter for brevity referred to as the "Company"). Your installation of the CallCar software and the use of CallCar services implies that you consent, unreservedly accept the content and all terms of the Agreement, and are bound by them.
Otherwise, please do not use the application or the services available from and through the CallCar application and network. The correct and legal use of the CallCar software by its users is mandatory. The manner of use of the CallCar software is the sole responsibility of each user (partner/driver/renter). We are constantly developing our services to improve and expand CallCar. For this purpose, it is possible that we may modify the terms of this Agreement in the future. Any modification of the terms will be immediately communicated to users and will come into effect upon their publication. Any use after the modification constitutes acceptance and unreserved consent to the relevant modifications. The updated terms and conditions of use of the application are always available.
The terms and conditions apply, directly or indirectly, to all CallCar services and products, which are available online, via any mobile phone device (android smartphone, iOS, Windows Phone), via email, or via telephone. By accessing, Browse, and using our website and our mobile application (hereinafter "Software") and/or by completing a booking, you accept and agree that you have read, understood, and fully agreed to the terms and conditions set out below (including the privacy statement). If you do not agree with the terms and conditions of use of the application, including the privacy statement, and are not willing to be bound by them, please do not install our application and/or delete it immediately, as well as any part of it, from your mobile phone, laptop or desktop computer and do not use it in any way. The Software is owned, operated, and offered exclusively by CallCar and is provided only for your personal, non-commercial use, in accordance with the terms and conditions set out below.
1. Terms, Definitions, and Interpretation For the purposes of this Agreement, the following definitions apply: The terms "We," "us," "our," and "Company" or "operator" refer to FOUR S. The term "Partners" refers to the companies cooperating with CallCar, through a corresponding agreement, who wish to advertise their services to third parties through the CallCar software. "Renter(s)" refers to the third party who uses the CallCar software and services through our mobile applications or our websites. "Driver(s)" refers to the drivers (private cars, or any other public or private vehicle belonging to a CallCar Partner), who are in an employment relationship with the CallCar Partner and who have successfully completed their registration as a driver in the CallCar application. "User(s)" refers to any user of the Software (Partner/Driver/Renter). "Software" refers to the mobile applications or web applications owned by CallCar. "CallCar Services" refers to the advertising services provided by CallCar to Partners and the Renter for the use of its software by the latter. "Rental Services" refers to vehicle rental services with or without a driver and driver rental services provided by CallCar Partners to Renters.
2. Object of Our Services Through the CallCar software, the Company provides information to prospective Renters and indicates to them the Partners who are connected (online) and available to provide to each Renter, upon their request, car rental services with a driver, or driver-only rental services, or car-only rental services. CallCar does not provide car rental services with or without a driver or driver rental services in any way. When providing our services, the information we publish is based on the information provided to us by the Partners. Therefore, Partners are fully responsible for providing their updated details to us and reporting their availability themselves for their display in the CallCar software. It is noted that despite the fact that we use reasonable skill and care in performing our CallCar services, we will not verify, and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including obvious and typographical errors), any interruptions (due to any (temporary and/or partial) breakdown, repair, maintenance or upgrade of our software or otherwise), inaccurate, misleading or untrue information or non-delivery of information. The Company does not determine the terms of provision of the Rental Services, which are determined by the Partners in accordance with applicable law. Each User remains responsible at all times for the accuracy, completeness, and correctness of the (descriptive) information displayed in our software. Our software does not constitute and should not be considered as a recommendation or endorsement of the quality, level, services, or rating of any user to whom it is made available. CallCar provides its software, its website(s), and any available technological means for the best promotion of Partner's Rental Services to Renters. Our services are available only for personal and non-commercial use. Therefore, you are not allowed to resell, deep-link, use, copy, monitor, display, download, or reproduce any content or information, software, products, or services available on our software, for any commercial or competitive activity or purpose.
3. Charges The use of the Company's application and website and the installation of the Company's software by Renters on their compatible electronic devices is free of charge. The Renter pays the Partner the consideration for the Rental Services provided to him by the latter, including relevant taxes and fees. By using the Rental Service, the contracting Renter chooses the payment method, i.e., either by charging their credit/debit card or in cash. CallCar does not determine the cost of Rental Services provided by Partners to Renters. CallCar services are provided to Partners for a monthly financial consideration, which will be agreed upon between the Company and the Partner in a separate agreement concluded between them. CallCar uses a third party (Bank or competent authorized body) that performs the payment (the "Payment Processor") to link your credit card account with our application and our services. The process of payments or credits, as applicable, regarding the use of the software will be subject to the terms, conditions, and privacy policy of the Payment Processor and your credit card issuer in addition to these terms. CallCar is not responsible for errors made by the Payment Processor. Regarding the use of the software, we will receive the relevant transaction details, which we will use solely in accordance with our privacy and cookie policy.
4. Privacy CallCar applies high ethical standards and specifications and respects your privacy. Except for disclosures required by law in any relevant jurisdiction, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our affiliated companies, including employees of our company and our affiliated companies, who have access to this information with our permission and who need to know or have access to this information to perform their services (including customer service). Please read our privacy statement carefully for more information.
5. Registration and use of the software You can only use CallCar Services if you have registered and accepted the terms of use. You will need to complete the registration form available with our software if you are interested in using our services either as a Partner, a Driver, or a Renter. The Renter's registration form is different from the driver's. By registering with CallCar, the User agrees:

Prohibitions/User Obligations Unless expressly stated, without the written consent of CallCar, you agree not to: (i) use, modify or incorporate into other software, or create a derivative work from any part of the software, (ii) sell, license (or sub-license), rent, assign, transfer, pledge or share your rights under this Agreement with or to anyone else, (iii) copy, distribute or reproduce the application for the benefit of third parties, (iv) modify, disassemble, decompile, reverse engineer, revise or enhance the software or attempt to discover the source code of the software.
7. Company Obligations The Company indicates to the prospective Renter the available Partners who can provide Rental Services. The Company does not evaluate the suitability, legality, or ability of each Driver. The Company is not responsible for any dispute that may arise between the Partner or the Driver and the Renter. The Company is not responsible for the correct execution of the Rental Services provided by the Partner or Driver. The Company is not responsible for the fulfillment of the financial terms agreed between the Partner and the Renter. The responsibility for selecting the Partner for the Rental Services desired by the Renter rests solely with the Renter. By accepting the provision of Rental Services, the Renter accepts that CallCar has no involvement in the contractual relationship between the Partner and the Renter.
8. Intellectual Property Any and all content, including but not limited to trademarks, logos, symbols, website names, industrial designs, images, photographs, background images, icons, navigation tools, texts, among others, of this software or related products and services displayed on the software, are protected by intellectual property rights and belong to CallCar or third parties authorized in writing by CallCar to develop activities related to its software. The User agrees to respect the intellectual property rights of CallCar. CallCar is not responsible for damages caused by unauthorized users who violated third party rights. The original Greek version of these terms and conditions may have been translated into other languages, depending on CallCar's objectives. In case of disagreement regarding the content or interpretation of these terms and conditions or inconsistency or discrepancy between the Greek version and any other language version of these terms and conditions, the Greek language version, to the extent permitted by law, shall prevail. The English version is available on our website (by selecting the English language) or will be sent to you by email.
Driver and Renter Privacy Statement Your privacy protection is important to CallCar. That is why we have created a Privacy Statement which covers how we collect, use, transfer, disclose, and store the information you share with us. Please take a moment to read, understand, and familiarize yourself with our privacy practices and let us know if you have any questions. This privacy statement applies to all CallCar services, our websites, and our software.
1. Privacy Policy Any information we request during your registration in the CallCar software is required in order to offer you our services. We will disclose your personal information to third parties only for the purpose of completing your booking by the Partners to provide you with the information or services you have requested or only with your explicit consent. We reserve the right to disclose your personal information to certain affiliated third parties including members of our own team and our trusted partners. It is noted that, according to European personal data protection legislation, specific security procedures have been observed to prevent the misuse of personal data.
2. Personal information we collect The personal information we collect is necessary to process your bookings (for Rental Services) and to provide CallCar services to you. All personal information we collect is submitted by you voluntarily when you register for the CallCar application, or during the use of CallCar services. When you download the CallCar mobile application, we collect your device type, your wireless carrier, and your unique device identifier (IMEI) and link them to your personal information, although we use this information primarily to support your account and provide you with CallCar services.
Registration and application usage Upon registering with CallCar and to use our Software, you will be asked to complete an electronic form with: your email address, mobile phone number, location information (your mobile or other location-aware device for transmitting location data), your full name, and your passport or ID number. This information is necessary to use the CallCar application. The information will not be reused for a purpose incompatible with the scope of our service, as described in the terms and conditions. The credit card information you provide in your personal profile when using the service is not stored by us, but is stored and used by the organizations that process credit card payments to the third parties to whom you owe for the Rental Services you received from them.
Renter Account You are responsible for safeguarding your personal device from which you access your personal account and you are fully responsible for all activities that occur in your account. In addition, GPS tracking information is collected when using our Software or the CallCar service. When you travel with a vehicle you have rented from a CallCar Partner, the Driver's mobile phone, and/or the vehicle's device will record the vehicle's route. We collect this information to provide you with your travel history and we do not use it for any other purpose. Furthermore, we collect your device type and its unique identifier (IMEI) when you use our mobile application. We use this information solely to provide you with a more personalized, updated application and features, as well as for the security of your account. If you use our services through your mobile device, we will track your geo-location information, so that you can locate drivers near your location, set your pickup location, and our drivers can find the location from which you wish to be picked up. We will not share this information with third parties for any purpose and will use this information solely for the purpose of fulfilling your request. We may also collect your geo-location even when you are not using CallCar services, only if you have consented, in order to effectively provide you with additional services based on your geo-location. You can at any time prevent our application from using your geo-location by disabling it at your device level. If you wish to apply for a job on our website, we will collect personal information such as your name, email address, phone number, and additional information that you voluntarily provide to us, such as your resume, gender, and nationality. We use the information collected in this area of our website to determine your qualifications for the position you have applied for and to contact you to arrange an interview.
3. What we do with the information we collect Our primary goal in collecting information is to offer you an improved experience when using the CallCar service. We use this information to closely monitor which features of the CallCar service are used most, so that you can view your rental history, evaluate rental services, and to identify the features whose improvement we should focus on, including usage patterns and geographical locations to determine where we should offer or focus services, features, and/or resources, to send SMS confirmations. We use the collected mobile information to be able to offer you the correct version of the application depending on your device type, for troubleshooting, and in some cases, for marketing and promotional purposes. The company uses Internet Protocol (IP) address to help diagnose problems with our server computer and to manage the software. Your IP address is used to help identify you and to gather broad demographic data. Your IP address does not contain personal information about you. We will send you information related exclusively to our services and in rare cases, when necessary. For example, if our service is temporarily suspended for maintenance, we may send you an email. If you do not wish to receive them, you have the option to deactivate/delete your account. In addition, we will send you a confirmation email when you rent a service from our partners/drivers. This email will contain information related to your booking and will be considered as a confirmation of your booking agreement with our partner/driver. You can opt out of receiving certain communications from CallCar, such as our newsletter which is informative and promotes new services and offers, by clicking on "Unsubscribe" at the bottom of each email or by sending us an email at [email protected]. Please note that even if you unsubscribe or opt out, we may send you announcements about vehicle bookings (e.g., SMS related to your booking: "the vehicle has arrived at the specified destination").
5. How we share Renter's personal information with Drivers As you know, our CallCar services are designed to connect vehicle drivers who provide transport service, or only the vehicle in the case of vehicle-only rental or only the driver in the case of driver-only rental, with you. To proceed with your booking, we must share your geo-location information with the driver who will provide the services to you. To complete the booking, we must provide the pickup location to the driver to expedite the route – the same information the driver would receive from you if you called them directly. We ask drivers to use this information for the provision of the transport service only, and not to store this information beyond the duration of each transport service they provide. By making your booking, you hereby authorize us to share relevant booking information with any driver designated by you to provide you with transport services. Please remember that this privacy statement applies only to the use and disclosure of information we collect from and/or about you. When you allow us to disclose information to drivers, the use and disclosure restrictions contained in this privacy statement will not apply to them. We clarify that while we as CallCar encourage users to comply with our data protection requirements, we will not be responsible if drivers do not comply with respect to your data. We do not control the privacy policies or actions of third parties, including drivers. Any complaints or questions regarding the driver's use of your information, or advertising by a driver, should be addressed directly to the driver. Drivers through the CallCar network may also have their own websites. CallCar is not responsible for how drivers may collect your personal information through their own websites. Please contact the respective driver regarding the privacy policy of their own website (if any) and how they will access or use your personal information on their personal website. At the end of your trip, there may be an evaluation for the services provided to you by our partners/drivers. If you evaluate the driver who provided you with the services, you hereby agree and accept that this information, including comments, may also be sent to the driver.
7. Cookies and other anonymous information When you use our software, we collect anonymous information, such as your IP address and basic website log information, such as your browser type and the pages you visited on our website, the browser language, the date and time of your request, and one or more cookies that can uniquely identify your browser. We may track the pages that led you to our software, although we do not associate this information with your personal information. We may also place small data files called "cookies" on your computer or mobile device. Cookies cannot harm your system in any way. In addition, they make your navigation easier by storing your settings. We send a "session cookie" to your device when you log in to your account. This type of cookie helps us recognize multiple visits to our website during the same session, so you don't have to enter your password on every page. Once you log out, close your browser or application, this cookie expires and no longer has any effect. We also use longer-lasting cookies to display your email address or mobile phone number on our login form, so that it is not necessary to re-enter your email address every time you log in to your account. You are free to decline our cookies if your browser allows it, but this may affect your use of our software. In this case, we are not responsible for the proper functioning of the application and any problems that may arise in the experience of using CallCar services. We may use third-party tracking services to track and analyze anonymous user information of our software. These third parties may use cookies to help track user behavior. We reserve the right to disclose anonymous information publicly without restrictions, including to third parties (vendors) who may help us enhance or provide CallCar software and services to third parties.
8. Controlling Your Information If your personal information changes, or if you no longer wish to use our service, you can correct, delete inaccuracies, or modify it by making the change on our members' information page, or by sending us an email at [email protected]. A member of our team will respond to your access request as soon as possible. We will retain your information (including geo-location) for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you with our services, contact us at [email protected]. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
9. How do we handle emails you send us? Our "Contact Us" button activates your email software and invites you to send your comments to a specific email inbox. When you send such a message, your personal data is collected only to the extent necessary to respond to you. If our inbox management team is unable to answer your question, they will forward your email to another department. You will be informed by email to which department your question has been forwarded. If you have any questions about the processing of your emails and your personal data, feel free to express them in your message.
10. Security Personally identifiable information, as well as geo-location information, that we collect is securely stored in our database, and we use standard, widely commercially available security practices, such as encryption and firewalls and SSL (Secure Socket Layers) to protect your information – as it pertains to your credit card number which we retain (we do not retain all of your credit card information). However, no matter how effective encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you provide will not be intercepted while being transmitted to us over the Internet, and any information you transmit to the company is at your own risk. We explicitly recommend that you do not disclose your password to anyone, in order to enhance your own security.
11. Changes to this privacy statement We may update this privacy statement to reflect our occasional changes in how we handle information. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by notice on our official websites or our partners' websites, before such change becomes active. We encourage you to periodically review this page for the latest information on our privacy practices. This privacy statement is part of the terms and conditions agreement and is interpreted in accordance with the relevant terms thereof.
12. PRICING POLICY AND PAYMENT TERMS For bookings requested by the Customer from CallCar, the price, which consists of the fees for the Transport Services, will be charged in the name and on behalf of CallCar using the credit card indicated by the Customer in the CallCar application before requesting the Services (including any taxes and overdue fees that may arise). Alternatively, the Customer may pay the amount in cash to the Driver at the end of the trip. The Customer agrees that the secondary payment method specified by the Customer in the CallCar application may be used if the primary payment method mentioned has expired, is invalid, or cannot be charged for other reasons. After payment, the Customer will receive a payment confirmation via email.
The following prices are charged for Transport Services booked through CallCar: Comfort - Minimum price: 36 euros for a minimum booking duration of 30 minutes. For bookings over 30 minutes:
