For the Partner the Driver and the Hirer

CALLCAR is an advertising service provider. CALLCAR has full and exclusive ownership of "CALLCAR" software which it provides to its Partners for use in order for the latter to advertise their products and/or services to third parties.

CALLCAR has its own software and itself advertises and promotes offers to third parties, services provided by companies active in the field of tourism and passenger transport.

It offers its services under the following terms of use (hereinafter for the sake of brevity as the "Agreement"), which constitute a legally binding agreement between the User and CALLCAR, which is a Greek company and/or any of its subsidiaries and cooperating companies (after hereinafter referred to as the "Company") for brevity's sake.

Your installation of CALLCAR's software and use of CALLCAR's services implies that you consent to, unreservedly accept the content and all terms of the Agreement and are bound by them. Otherwise, please do not use the application or the services available from and through the application and the CALLCAR network.

The correct and legal use of the CALLCAR software by its users is mandatory. The use of the CALLCAR software is the sole responsibility of each user (partner/driver/lessee).

We are constantly evolving our services to improve and expand CALLCAR. For this purpose, we may modify the terms of this Agreement in the future. Any modification of the terms will be immediately communicated to the users and will take effect from their publication. Any use after modification constitutes unconditional acceptance and consent of the relevant modifications. The updated terms and conditions of use of the application are always available

The terms and conditions apply, directly or indirectly, to all CALLCAR services and products, available online, through any mobile phone device (android smartphone, ios, windowsphone), through electronic mail (email ) or by phone. By accessing, browsing and using our website and mobile application (hereinafter "Software") and/or by completing a booking, you acknowledge and agree that you have read, understood and fully agreed to the terms and conditions listed below (including the privacy statement).

If you do not agree to the terms and conditions of use of the application, including the privacy statement and are not willing to be bound by them, please do not install our application and/or immediately delete it, as well as any part of it, from the mobile phone, the laptop or your computer (desktop) and do not use it in any way.

The Software is owned, operated and offered exclusively by CALLCAR and is provided only for your personal, non-commercial use, subject to the terms and conditions set forth below.

  1. Terms, Definitions and Interpretation

For the purposes of this Agreement, the following definitions shall apply:

The terms "We", "us", "our" and "Company" or "entity" refer to CALLCAR

The term "Partners" refers to companies collaborating with CALLCAR through a corresponding contract, which wish to advertise their services to third parties through CALLCAR's software,

"Tenant(s)" refers to the third party, who makes use of CALLCAR's software and services through our mobile phone applications or through our websites.

As "Driver(s)" it refers to the drivers (EIX, or any other vehicle of public or private use belonging to a CALLCAR Partner), who is in a dependent employment relationship with the CALLCAR Partner and who has successfully completed the registration as a driver in the CALLCAR application,

"User(s)" refers to each user of the Software (Partner/Driver/Tenant)

"Software" refers to mobile applications or web applications owned by CALLCAR,

"CALLCAR Services" refers to the advertising services provided by CALLCAR to Partners and the Lessee for the use of its software by the latter.

"Rental Services" refers to vehicle rental services with or without a driver and driver rental services provided by CALLCAR Partners to Renters.

  1. Object of our services

Through the CALLCAR software, the Company provides information to the prospective Lesseees and indicates to them the Partners who are connected (online) and available to provide to each Lessee, following his relevant order, car rental services with a driver, or rental services driver only, or car only rental services.

CALLCAR does not provide car rental services with or without a driver or driver rental services in any way.

In providing our services, the information we make public is based on information provided to us by Partners. Therefore, Affiliates are fully responsible for providing their updated details to us and reporting their availability themselves, for their appearance in the CALLCAR software. Please note that although we use reasonable skill and care in performing our CALLCAR services, we will not verify whether, and cannot guarantee that all information is accurate, complete or correct, nor can we be held responsible for any errors. (including obvious and typographical errors), any interruptions (due to any (temporary and/or partial) breakdown, repair, maintenance or upgrade of our software or otherwise), inaccurate, misleading or untrue information or non-delivery of information.

The Company does not determine the conditions for the provision of the Leasing Services which are determined by the Partners in accordance with the applicable legislation.

Each User retains responsibility at all times for the accuracy, completeness and correctness of the (descriptive) information displayed in our software. Our software is not and should not be considered a recommendation or endorsement of the quality, level, services or rating of any user to whom it is made available. CALLCAR provides its software, website(s) and any available technological means to better promote Leasing Partners' services to Tenants.

Our services are available for personal and non-commercial use only. Therefore, you may not resell, deep-link, use, copy, monitor, display, download, or reproduce any content or information, software, products or services available on our software, for any commercial or competitive activity or purpose.

  1. Charges

The use of the Company's application and website and the installation of the Company's software by the Tenants on their compatible electronic devices is free of charge.

The Lessee shall pay the Partner the consideration for the Rental Services provided by the latter including relevant taxes and fees. By using the Leasing Service, the contracting Lessee chooses the way of paying the rent, i.e. either by debiting his credit/debit card or in cash.

CALLCAR does not determine the cost of Rental Services provided by Partners to Renters.

CALLCAR services are provided to the Partners for a monthly financial consideration which will be agreed between the Company and the Partner with a separate agreement concluded between them.

CALLCAR uses a third party (Bank or relevant authorized entity) that executes the payment (the "Payer") to link your credit card account with our application and our services. The processing of payments or credits, as applicable, in relation to the use of the software will be subject to the terms, conditions and privacy of the Payer and your credit card issuer in addition to these terms. CALLCAR is not responsible for mistakes made by the person making the payment. In relation to the use of the software, we will receive the relevant transaction details, which we will use exclusively in accordance with the terms of the privacy and cookie statement.

  1. Privacy

CALLCAR applies high ethical standards and specifications and respects the protection of your privacy. Except for disclosures required by law in any relevant jurisdiction, we will not disclose your personal information to third parties without your consent. However, we reserve the right to disclose your personal information to our affiliated companies, including employees of our company and our affiliated companies, who have access to that information with our permission and who have a need to know or access to this information to perform their services (including customer service. Please read our privacy statement carefully for more information.

  1. Registration and Use of the Software

You may use the CALLCAR Services only if you have registered and accepted the terms of use.

You should complete the registration form provided with our software if you are interested in using our services as either a Partner, Driver or Hirer. The Lessee's registration form is different from that of the driver.

By registering with CALLCAR, the User agrees:

  1. to provide true, accurate, complete and up-to-date information about himself or the company he legally represents in the registration form and to update it whenever necessary. CALLCAR bears no obligation to monitor or check or cross-check the accuracy of the information provided by the User. In the event that CALLCAR has reasonable grounds to suspect that this information is not accurate, it has the right to refuse the registration of the prospective User or to immediately suspend or terminate the registration of the account of the already registered User and deny him the provision of any use, present or future, of CALLCAR services that require registration.
  2. that you will not use CALLCAR's software for any illegal purpose; to transfer files containing viruses, trojans or other harmful programs; to access or attempt to access the accounts of other Users, interfere or attempt to bypass any security measures; to disseminate any content that is defamatory, obscene or harassing, threatening or abusive to any person or group of persons, based on religion, gender, sexual orientation, race, nationality, age or disability or anything similar,
  3. acknowledges that the Company has no control over the content of information and conversations between users. In case you wish to complain about another user, please contact us by email at [email protected]
  4. to comply with all applicable laws of the state when using the CALLCAR Services.
  5. that the nickname or email address you use to register for the software does not resemble the CALLCAR company name. Also, nicknames that are considered offensive can be deleted
  6. It is at the discretion of the driver to accept or reject a call and inform the system about the availability of the vehicle to customers
  7. In case of any unauthorized use of your account, you should immediately inform CALLCAR at [email protected]

The User may change, modify or delete their registration information at any time, in accordance with our Privacy Statement.

After the Renter, using the CALLCAR Services, chooses the Partner who will provide him with the type of Rental Services he desires, he contacts the Driver authorized by the Partner and requests the provision of Rental Services. The lessee is obliged to wait for the response of the Driver, who can accept or reject the provision of Lease services. If the Guide accepts the Lessee's proposal, the latter can cancel it for any reason, with a special action through the Software.

Users acknowledge that CALLCAR is not responsible for any delays, cancellations, inability to provide Lease services by the Partner and/or Driver to the Lessee.

  1. Prohibitions/Obligations of Users

Except as expressly stated, without CALLCAR's written consent you agree not to: (i) use, modify or incorporate into other software, or create a derivative work from any part of the software, (ii) sell, license (or sub -license), lease, assign, transfer, pledge or share your rights under this Agreement with or to anyone else, (iii) copy, distribute or reproduce the Application for the benefit of third parties, (iv) modify, disassemble, disassemble, reassemble , revise or improve the Software or attempt to discover the source code of the Software.

  1. Company Obligations

The Company indicates to the prospective Lessee the available Partners who can provide Leasing Services. The Company does not evaluate the suitability, legitimacy or competence of each Guide. The Company is not responsible for any kind of dispute that may arise between the Partner or the Driver and the Hirer. The Company is not responsible for the correct execution of the Rental Services provided by the Partner or Guide. The Company is not responsible for the fulfillment of the financial terms agreed between the Partner and the Lessee. The responsibility for the selection of the Partner for the Lease Services desired by the Lessee lies exclusively with the Lessee. By accepting the provision of the Leasing Services, the Lessee accepts that the has no involvement in the contractual relationship between the Partner and the Lessee.

  1. Intellectual Property

Any and all content, including but not limited to the trademarks, logos, symbols, website names, industrial designs, images, photographs, background images, icons, navigation tools, text among others, of this software or related products and services displayed in the software, are protected by intellectual property rights and belong to CALLCAR or third parties authorized in writing by CALLCAR to develop activities related to its software. The User agrees to respect the intellectual property rights of CALLCAR.

CALLCAR is not responsible for damages caused by an unauthorized user who violated the rights of third parties.

The original Greek version of these terms and conditions may have been translated into other languages, depending on CALLCAR's objectives. In the event of any dispute regarding the content or interpretation of these terms and conditions or any inconsistency or inconsistency between the Greek version and any other language version of these terms and conditions, the Greek language version shall prevail to the extent permitted by law. The English version is available on our website (by selecting the English language) or will be sent to you by email.

    • The full amount is charged at the time of booking.
    • Booking Cancellation:
      • Up to 7 days before pickup: Full refund, minus a €25 fee.
      • Up to 2 days before pickup: 50% refund (we retain 50%, with a
        minimum charge of €25).
      • Within 2 days of pickup: No refunds.
  2. Pay on Arrival
    • A €25 fee is charged at the time of booking.
    • Booking Cancellation: No refunds.

Driver and Renter Privacy Statement

Protecting your privacy is important to CALLCAR. That's why we've created a Privacy Statement that covers how we collect, use, transfer, disclose and store the information you share with us. This privacy statement applies to all CALLCAR services, our websites and our software.

  1. Privacy Policy

Any information we ask for when you register with CALLCAR's software is required in order to offer you our services.

We will disclose your personal information to third parties only for the purposes of completing your booking with Partners to provide you with the information or services you have requested or only with your express consent. We reserve the right to disclose your personal information to certain affiliated third parties including members of our own team and trusted partners.

It is noted that, in accordance with European legislation on the protection of personal data, specific security procedures have been followed to prevent the misuse of personal data.

  1. Personal Information We Collect

The personal information we collect is necessary to process your reservations (for Rental services) and to provide the CALLCAR services to you. All personal information we collect is voluntarily submitted by you when you register for the CALLCAR application, or when using the CALLCAR services.

When you download the CALLCAR mobile app, we collect your device type, your wireless carrier, and your individual device identity (IMEI) and associate it with your personal information, although we use this information primarily to support your account and to provide you with the CALLCAR services.

Registration and use of application

When you register with CALLCAR and in order to be able to use our Software you will be asked to fill out an electronic form with: your email address (email), mobile phone number, location information (your mobile or other location reporting device your for the transmission of location data), your name and your passport or ID number . This information is necessary to use the CALLCAR application. The information will not be reused for a purpose inconsistent with the scope of our service as described in the terms and conditions.

The credit card information you provide in your personal profile when using the service is not stored by us, but is stored and used by the organizations that process the credit card payment to the third parties you owe for the Leasing services you received from them. .

Tenant Account

You are responsible for safeguarding your personal device from which you access your personal account and are fully responsible for all activities that occur under your account.

In addition, location information (GPS) is collected when using our Software or the CALLCAR service. When you travel with a vehicle that you have rented from a CALLCAR Partner, the Driver's mobile phone and/or the vehicle's device will record the vehicle's course. We collect this information to provide you with a history of your trips and do not use it for any other purpose.

In addition we collect your device type and its unique identifier (IMEI) when you use our mobile app, we use this information for the sole purpose of providing you with a more personalized, updated app and features, and for account security your. If you use our services through your mobile device, we will track your geo-location information so that you can locate drivers near your location, set your pickup location, and our drivers can find the location from which you wish to be picked up. We will not share this information with third parties for any purpose and will use this information solely for the purpose of fulfilling your request. We may also collect your geo-location even when you are not using the CALLCAR services, only if you have consented, so that we can effectively provide you with our additional services based on your geo-location. You may at any time further prevent our application from using your geolocation by disabling it at your device level.

If you wish to apply for a job on our website we will collect personal information such as your name, email address, telephone number as well as additional information that you voluntarily provide to us such as your CV, gender and nationality. We use the information collected in this area of ​​our website to determine your qualifications for the position you have applied for and to contact you to arrange an interview.

  1. What we do with the information we collect

Our primary goal in collecting information is to provide you with an improved experience when using the CALLCAR service. We use this information to closely monitor which features of the CALLCAR service are used the most, so that you can view your rental history, evaluate rental services, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources, to send confirmation SMS, we use the mobile information collected to be able to offer you the correct version of the application according to your device type, to solve problems and in some cases, for marketing and promotional purposes.

The company uses Internet Protocol (IP) addresses to help diagnose problems with our server computer and to administer the software. Your IP address is used to help locate you and gather broad demographic data. Your IP address does not contain any personal information about you.

We will send you information related solely to our services and on rare occasions when this is necessary. For example, if our service is temporarily suspended for maintenance, we may send you an email. If you do not wish to receive them, you have the option to deactivate/delete your account. Additionally we will send you a confirmation email when you hire a service from our partners/drivers. This email will contain information related to your booking and will be considered as a confirmation of your booking agreement with our partner/driver.

You can opt out of receiving certain communications from CALLCAR, such as our newsletter which is informative and promotes new services and offers, by clicking "Unsubscribe" at the bottom of each email or by emailing us at help @Fours.com. Please note that even if you unsubscribe or opt-out, we may send you communications about vehicle bookings (e.g. sms related to your booking: "vehicle has arrived at specified destination").

  1. How we share Renter's personal information with Drivers

As you know, our CALLCAR services are designed to connect the drivers of the vehicles providing the transportation service, or only the vehicle in the case of renting the vehicle only, or only the driver in the case of renting the driver only, with you. In order to process your booking we need to share your geo-location information with the driver who will be providing the services to you. To complete the booking, we need to provide the pick-up location to the driver to expedite the ride – the same information the driver would receive from you if you called them directly. We ask that drivers use this information to provide the transportation service only, and do not store this information beyond the duration of each transportation service they provide. Upon making your reservation, you hereby authorize us to share relevant reservation information with each driver designated by you to provide transportation services to you.

Please remember that this privacy statement only applies to the use and disclosure of information we collect from and/or about you. When you allow us to disclose information to drivers, the restrictions on use and disclosure contained in this privacy statement will not apply to them. We make it clear that while we at CALLCAR encourage users to comply with our data protection requirements, we will not be responsible if drivers do not comply with your details. We do not control the privacy policy or actions of third parties, including guides. Any complaints or questions about a driver's use of your information, or advertising by a driver, should be addressed directly to the driver. Drivers through the CALLCAR network may also have their own websites. CALLCAR is not responsible for how drivers may collect your personal information through their own websites. Please contact the relevant driver regarding their own website's privacy policy (if any) and how they will access or use your personal information on their personal website.

At the end of your ride, there may be a rating for the services provided to you by our partners/drivers. If you rate the guide who provided you with the services, you hereby agree and accept that such information, including feedback, may also be sent to the guide.

  1. Cookies and other anonymous information

When you use our software, we collect anonymous information such as your IP address and basic website logging information such as your browser type and the pages you browsed on our website, browser language, date and time of the request and one or more cookies that can uniquely identify your browser. We may identify the pages that led you to our software, although we do not associate this information with your personal information.

We may also place small data files called "cookies" on your computer or mobile device. Cookies cannot harm your system in any way. In addition, they make your navigation easier as they save your settings. We send a "session cookie" to your device when you sign in to your account. This type of cookie helps us recognize when you visit multiple areas of our website during the same session, so we don't have to ask you for your password on every page. Once you log out, close your browser or application, this cookie expires and no longer has any action. We also use longer-lasting cookies to display your email address or mobile phone number on our login form, so that you don't have to re-type your email address every time you log into your account. In this case, we bear no responsibility for the correct operation of the application and any problems that may arise in the experience of using CALLCAR's services.

We may use third-party tracking services to track and analyze anonymous user information of our software. These third parties may use cookies to help track user behavior.

We reserve the right to disclose anonymous information publicly without limitation, including to third parties (vendors) who may help us enhance or provide CALLCAR software and services to third parties.

  1. Control of your details

If your personal information changes, if you no longer wish to use our service, you can correct, delete inaccuracies, or amend it by making the change on our member information page, or by emailing us at [email protected] . A member of our team will respond to your access request as soon as possible.

We will retain your information (including geolocation) for as long as your account is active or as necessary to provide you with services. If you wish to cancel your account or request that we no longer use your information to provide you with our services, please contact us at [email protected]. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

  1. How do we handle the emails you send us?

Our Contact button activates your email software and invites you to send your comments to a specific email box.

When you send such a message, your personal data is collected only to the extent necessary to respond to you. If our mailbox management team is unable to answer your question, they will forward your email to another service. You will be notified by email to which service your question has been forwarded.

Personally identifiable information such as geolocation information that we collect is stored securely in our database and we use standard, commercially available security practices such as encryption and firewalls and SSL (SecureSocketLayers) to protect your information – such as to your credit card number that we maintain (we do not retain all of your credit card information). However, no matter how effective encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that the information you provide will not be intercepted as it is transmitted to us over the internet, and any information you transmit to the company is at your own risk. We strongly recommend that you do not disclose your password to anyone, in order to enhance your own security.

We may update this privacy statement to reflect our occasional changes in the way we manage information. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by notice on our or our partners' official websites, before such change becomes effective. We encourage you to periodically review this page for the latest information about our privacy practices. This privacy statement forms part of the terms and conditions agreement and is interpreted in accordance with the relevant terms of the latter.

According to the Greek legislation L.4530/2018 and L. 4512/2018 par.210A the minimum rental time is three (3) hours.

Competent for the resolution of any dispute is the Greek courts
